Market and Showrules

The market and show regulations refer to the example Market regulations and the hints of the Ministerium Ländlicher Raum, Baden Württemberg, for of pet Markets and Animal Markets, December 10, 1999.

§ 1 Application
These rules apply to all Betta splendens Shows and livestock Markets , which are held by
Europäischen Halbmond Betta Besitzer Club e.V. (EHBBC)

§ 2 Subject of the Markets
Markets and Auctions are not allowed to gain any source of income.
There are only allowed:
1. high-breed bettas, if they come out of own breeding and the trading is not
    permitted by any international animal or conservation laws.
2. Plants, which are growing in water tanks and if the trading is not permitted by any
    international or conservation laws.
It is not allowed to offer any pets or plants, that where bought from third parties to
resell on the markets or auctions.
It is forbidden to sell any aquaristic equipment in the rooms, where the event takes
place.

§ 3 Suppliers
To be allowed to offer on the Market, it is recommended to hand in a registration at the administration office of the EHBBC in the given time. All suppliers must be aware of the national and international instruction to conservation laws, an expert proof is desirable.
The expert documents regarding to the international conservation guidelines have to be carried along.
EHHBC members and people with a German expert proof should be given precedence to the market places.
Offering and Selling is only allowed for commercial Trader or commercial breeder, if they have the permission by the board after handing in the certificate regarding §11 German Animal Law.
It is not allowed to trade any pets or plants bought on the market to a third person on
the market.
Members that didn`t pay in the annual member fee are treated as extraneous.

§ 4 Regulations by Law
The following rules are to observe regarding German and international animal laws
and contributions.
1. pets are only allowed to be offered in closed rooms.
2. pets that are offered must be healthy and unhurt.
3. As Containers only transport-boxes and tanks are allowed, that give the offered pet enough space to comply their natural requirements. In case that any laws are handed out regarding this, the law has to be noticed.
4. The tanks have to be heated to a temperature complying the requirements of the offered pets. The offered pets have to be kept in water conditions that fulfil their requirements.
5. Males of Betta splendens have to be separated and should not have the opportunity to get in sight of each other. Volume of water minimum 1,5 litre.
6. The sales tanks have to be looked after by the persons who offers them or a person that has been engaged to do. Taking care, that nobody is knocking at the tanks or disturbing the pets by any other sort of manipulation is     strongly recommended
7. The sale tanks have to be placed in the height of at least 70-80 cm above the floor. The sale tanks should only be looked in from above and one sight. Under regarding §4.8 they also may be looked in from behind, if the sale     is made from behind.
8. Tempered Water with water conditions fulfilling the requirements for the offered pets must be kept ready in case that the water level lowers because of the taking out for transport bags too much.
9. In the rooms where the market takes place smoking is prohibited during the market.
10. For the delivery and the transport of the animals only fish transportation bags which are offered in particularly for it (rounded off corners) and transportation containers with appropriate warming and viewprotectors should be used.
11. Every Supplier is allowed to offer 10 Betta splendens males at one time in the market places that is given to him. More fishes are to be kept in the transport boxes (styrobox, heatpack if required). The box should only be opened to put in the fishes.
12. Offering fishes in transport bags is prohibited.

§ 5 Advice and Information
The trading tanks have to be notified with signs that are readable from a distance of 50cm at least and marked with:
1. Name and address of the breeder / seller. The address has to be given to the club.
2. Name of the fish (scientifically / german)
3. Origin
4. Take care sheet
5. Price
The seller has to inform the costumers about feeding and natural needs of the fishes he sells!

§ 6 Surveillance of the Regulations
The authority over the hole market is the supervisor of the market place. The supervisor of the market place has to be guarded by stock personal with special knowledge. All stuff members must be signed as what they are.
The supervisor of the market place is allowed to bar persons that break any of the market rules or any further laws from the market immediately and send them out.
For any breaking of rules the supervisor of the market place could bar sellers or visitors out for further shows, either on time or forever from taking part in any other markets by the club.

§ 7 Liability
If the club offers only the possibility to trade freshwater fishes and plants to interested persons, business by law is only made between the seller and the costumer, not between the seller and the club. Same rule stands for exchange of any stock.
Further on the EHBBC is not responsible in any case for the brought pets, plants or other stuff and the complete interior. Each seller has to convince himself of the normal condition and function of every mechanisms and things which the club makes available for the stock exchange/exhibition.

§ 8 Regulation by Commissions
The German commission responsible for the laws written down in the German „Tierschutzgesetz“ has to be offered free visiting of the market at any time. The supervisor of the market place and other members of the stuff has to help the commission on order.

§ 9 Attachements
The Market and Show regulations can be attached what would give the attachment the same regulating power as the regulation itself. Attachments need to follow the principle rules of the regulation.

§ 10 Public
Before the market starts the regulations will be put up at places where they easily can be noticed. Every seller has to sign a document which will say he agrees to the regulations.

§ 11 Several other Subjects
Set up of the market and joining of the sellers at least 1 h before the market starts. Helping the other is a key rule.
The EHBBC receives 15% of the trading income from every seller. The splitting will take part after the end of the market / auction and will be guided by the Treasurer of the club.
The supervisor of the market place can be represented by a person, which is chosen of him.
Beginning of stock exchange/exhibition takes place to the time specified in the respective program, and/or after the release by the supervisor of the market place.
Any selling or trading before that point of time is not permitted and could be followed by an immediate exclusion from the stock exchange/exhibition.
The written out stock exchange end is to be kept. A previous packing or preparing of the animals for transport is not permitted. Each seller has to take his assigned place at the latest ¼ hour before beginning of the stock exchange. In this quarter of an hour control takes place via supervisor of the market place or via one of his chosen
adepts. Each seller is only allowed to use the place which is assigned to him. For all damage or damages by inappropriate handling or not functional bring along implements only the causers, and/or owners are responsible. A constant supervision of the animals by the seller/exhibitor or one of his assigned person is necessity.
The containers are to be protected by the seller against unauthorized or unsupervised opening. Only healthy animals may be offer/issued. Draft is to be avoided in the exhibition/stock exchange areas. Knocking or vibrating on the containers with animals is animal protection adverse and thus forbidden.
